by ndmuscleA North Carolina man was sentenced Monday, May 6 in Pennington County District Court for a felony charge of third degree burglary.
Alvin Lee Fitzgerald Jr., 49, Ellenboro, N.C., was sentenced to 36 months in prison. He w a s ordered to supply a DNA sample . Fitzgerald was also ordered to pay $210 in fees and fines, and $2,522.50 in restitution. A jury found him guilty of the charge after a one-day trial Thursday, April 11 .
The charge stemmed from a report to police on June 14 at about 10:30 p.m. According to the complaint, a McMullen Auto Sales employee reported that a suspicious person pulled on the back door of the business. Once the man saw her, he started walking toward Kmart. Police found the man and identified him as Fitzgerald. During a patdown search, they found a softball size amount of coins in his pants pocket. He also had a tire gauge. Fitzgerald told the officers that he was on foot and trying to see his daughter in Badger.
Officers found that Fitzgerald had an outstanding warrant in Georgia for burglary. However, law enforcement there would only extradite him if he was located within 250 miles. Officers released Fitzgerald since they had no reason to arrest him.
The following morning, at about 8:45 a.m., Deputy Police Chief Craig Mattson received a report of a burglary at Speed’s Automotive Service, which is located near McMullen Auto Sales. The complaint indicated about $30 in change had been stolen out of a candy and pop machine that had been pried open. Police lifted fingerprints off of the machine, and the fingerprints were sent to the Minnesota Bureau of Criminal Apprehension.
Given the events of the past evening, Mattson ran Fitzgerald’s criminal history and found Fitzgerald had numerous felony burglary charges and convictions dating back to 1985. He served prison time for burglaries in five states.
That night, at 9:30 p.m., Fitzgerald was arrested in Thief River Falls. Fitzgerald was interviewed the next day and he didn’t deny the burglary. According to the complaint, he said, “It looks like you have all the evidence y ou need against me.” At one time, he asked Mattson to contact the prosecuting attorney to work out a deal for work release and inquired about sentencing guidelines for this offense in Minnesota.
Amanda Ruth Johnson, 32, Thief River Falls, was granted a 10-year stay of imposition for a charge of felony theft. As a condition of that sentence, she was ordered to serve 240 hours of community work service. Johnson was also ordered to serve 10 years on supervised probation. If she successfully completes probation, the charge will be reduced to a misdemeanor.
Johnson was also ordered to have no contact with the victim. She was ordered to undergo a psychological evaluation/treatment and to take medications in their prescribed dosage and frequency. Johnson was ordered to pay $135 in fees and fines. The certificate of restitution indicated she was also ordered to pay $6,064 in restitution – $2,500 to Pennington Main and $3,564 to its insurance carrier, Nationwide Insurance.
The charge stemmed from a report to police on Dec. 21 at about 7:30 a.m. by the owner of Pennington Main. According to the complaint, he reported that Johnson, an employee, was taking money out of the cash register and putting it in her purse. He provided video of the incident from a day earlier. The owner previously reported to the investigator that his cash register was short numerous times within the last two months, but he wasn’t sure who was responsible.
The complaint indicated that Johnson told the investigator that she stole money several times within the last two months. She said she stole $260 in cash that day. The complaint indicated that Johnson said she first took money at the beginning of November and started taking more and more money as life seemed to get easier when her bills were paid. The investigator retrieved $260 in $10 bills from her. The owner provided information about all of the shortages since the beginning of November. The shortages totalled $5,800.
